Apple’s Lawsuit Against Psystar Gets Go Ahead From Bankruptcy Judge
Bankruptcy may not be all it’s cracked up to be, at least for Psystar, the Mac clone maker that has been fighting off Apple’s legal claims of copyright infringement.
Psystar filed for Chapter 11 bankruptcy last May, putting a temporary halt to any current litigation against the company while the bankruptcy judge started the process to sort out its finances. Apple quickly filed a motion to allow the infringement case to continue while Psystar is in bankruptcy.
The bankruptcy judge sided with Apple today, allowing the lawsuit against Psystar to go forward. At this point Psystar can appeal the decision, although no grounds for an appeal have yet been mentioned.
With the Apple lawsuit moving forward, it seems likely that Psystar will have an incentive to come to an out-of-court agreement with Apple, thus ending the lawsuit and most likely leading to the demise of the Mac clone portion of Psystar’s business.
